Note:

  1. Before applying for a new dock, a modification, or replacement to an existing dock the owner(s) must provide a survey that shows that they own the land up to the waterline at an elevation of 5 feet as measured by the Lagoon elevation scale located on the piling at the sanitary pumping station dock adjacent to the lock. If the property line does not extend to the waterline as defined above, the Owner(s) must obtain a Quit Claim Deed (See QHRRP 5000-025 (Quit Claim Deeds and Easement Relocation) prior to proceeding with the application process.

Restrictions
The Sovereign Submerged Land Easement (SSLE) from the Florida Department of Environmental Protection (FL DEP) and the Queen’s Harbour CCRE restricts/prohibits the building of any type of structure into the salt-water marshes around Queen’s Harbour. No docks, decks, or structures of any sort are allowed into the marshlands.

A Declaration of Restriction was recorded in Official records Volume 6802, page 1573 of the public record of Duval County, Florida, in order to obtain permits for the development of Queen’s Harbour Yacht & Country Club. The Declaration of Restriction provides in part that Queen’s Harbour Yacht & Country Club Owners Association, Inc. (the Association) is prohibited from allowing construction of “any dock or other structure within the creeks or marshes except for the lock between the upland lagoon and Pablo Creek and its appurtenant structures.” The provisions of Declaration of Restriction can be found at CCRE Article VI, Section 6.18.
