Note:  CCRE Exhibit “C” was the initial guidelines established for QHYCC. CCRE Article V, Section 5.2(b)(i) authorizes the ARB to update these guidelines from time to time.  These guidelines reflect the most current updates.

Purpose
The Architectural Planning Criteria are deemed to be the standard or “guidelines” for all new construction and property improvements and no new construction or property improvement may be made without ARB approval.
Scope
These guidelines apply to every property owner in QHYCC. Additionally, these units are subject to additional guidelines as to their use and appearance…

Variance
These guidelines are intended as “guidelines” to which adherence shall be required by each owner or builder.

All variances from these requirements must be approved by the ARB by 2/3 affirmative vote of those members present. The ARB has the responsibility and authority to review requests for a variance from any requirement. The applicant requesting a variance must demonstrate to the ARB…

  • that the variance is in the best interest of and is compatible with the character of Queen’s Harbour.
  • why it should be granted.

Note:  Variance considerations may include, but are not limited to, the uniqueness of the situation, the hardship involved, environmental considerations and other alternatives. A variance shall be evidenced by a written document stating which criteria/conditions are subject to variance and specific conditions that must be met, if any. Variances are generally not allowed except in extraordinary circumstances.

ARB Permit
Upon ARB approval, an ARB permit is issued requiring completion of the project within a specified period (independent of regulatory permit requirements [e.g., city building permits, St. Johns River Water Management District permits, etc.]) as follows…

  1. New Home Construction – 18 months
  2. Major Projects (Additions, Pools / Enclosures) – 12 months
  3. Minor Projects (Landscaping / Fencing / Pavers / etc.) – 90 days
  4. Trees – 60 days

Note:

  1. Property owners are required to submit progress reports via email to the ARB Coordinator every 90 days.  This is to ensure the projects are continuing in the time frame shown on the permit.
  2. The orange permit issued by the ARB coordinator must be posted prior to and during construction. Failure to do so may result in a fine.
ARB permit extension
Regarding ARB permit extensions…

  • A permit may be extended by the ARB for up to 6 months.
  • In extraordinary circumstances, a second extension of up to 6 months may be approved by the ARB.
  • Extension requests must be submitted to the ARB Coordinator for review at a regularly scheduled ARB meeting PRIOR to permit expiration.
  • Extensions of up to 2 weeks can be approved by the ARB Coordinator.
ARB permit expiration
If the ARB permit expires, including approved extensions the project will be cancelled and the deposit will be forfeited.  See QHRRP 5000-015 (Review & Construction Impact Fees (CIF) and Deposits.
