CCRE for Providence Island at Queen’s Harbour

Purpose
The purpose of this policy is to clarify and resolve certain overlapping and/or conflicting responsibilities of maintenance and use restrictions as may exist between the governing documents of the Master Association and the Sub-Association.
Policy
Property owners within Providence Island belong to both associations and are obligated to comply with the governing documents of both the Master Association and the Sub-Association.

Associations:

  • Queen’s Harbour Owners Association, Inc. (Master Association) has jurisdiction over Providence Island, and the governing documents for the Master Association govern Providence Island.
  • Providence Island is subject to the CCRE for Providence Island at Queen’s Harbour (the “Providence Declaration”) and the jurisdiction of the Providence Island at Queen’s Harbour Owners Association, Inc. (the “Sub-Association”).
Responsibilities of parties
Where any item of maintenance, compliance and/or enforcement is specifically addressed in the governing documents of Providence Island at Queen’s Harbour (a/k/a “Unit 30”), it shall be the responsibility of the Board of Directors of Providence Island at Queen’s Harbour to enforce such item.

If the Master Association chooses to do so, it may consider a violation of the Providence Declaration to be the equivalent of a violation of the Master Association’s governing documents and take enforcement action.  The Master Association has the right, but not the obligation, to enforce the Providence Declaration and any rules passed by the Providence Island Board of Directors in the event the Sub-Association fails or refuses to perform such act.
