Note:  CCRE Exhibit “C” was the initial guidelines established for QHYCC. CCRE Article V, Section 5.2(b)(i) authorizes the ARB to update these guidelines from time to time.  These guidelines reflect the most current updates.

Purpose
One of the purposes of the Architectural Review Board (ARB) is review and make a determination with regard to a submitted application. ARB meetings are held as outlined in QHRRP 5000-001 (Architectural Review Board (ARB) Guidelines).  During the meeting projects will either

  • Approved
  • Tabled, or
  • Denied

Note:  A letter from the ARB will be issued to property owners with determination and any amplifying information. Refunds, if applicable will be in accordance with QHRRP 5000-015 (Review & Construction Impact Fees (CIF) and Deposits).

Approved
Upon receipt and review of the submitted application, the ARB will approve an application if…

  • submitted with all requirements/documents(s) met.  A permit will be issued with the approval date and the expiration date of the permit.
  • submitted with requirements/document(s) missing.  This approval is contingent on the ARB Coordinator receiving the missing requirements within 14 days of the approval date.  Failure to provide the required requirements/document(s) within the 14 days will result in withdrawal of the approved application and a denial letter issued.
Tabled
Upon receipt and review of the submitted application, the ARB will table an application if…

  • the submitted application/documents are not per the requirements in the ARB Guidelines.
  • the project description isn’t clear.
  • the ARB has further questions concerning the project.

Note:  The property owner has until the next scheduled ARB meeting to provide the requirements/document(s) outlined in the “Tabled” letter.  Failure to provide the required requirements/document(s) at the next scheduled ARB meeting will result in a denial letter being issued.

Denied
Upon receipt and review of the submitted application, the ARB will deny an application if…

  • a project violates ARB Guidelines.
  • the ARB considers the requested project to be out of character for Queen’s Harbour.

Note:  Property owners may resubmit after 30 days.

Resubmittals
Follow these steps if you desire to resubmit your application.

  1. Submit a new application.  Include the words “RESUBMITTAL” in the upper right-hand corner of the application along with the initial ARB meeting date.  The project description must include information on the project and why it is being resubmitted.
  2. New full sets of requirements/document(s) and photographs marked as “RESUBMITTAL” along with the date of the initial ARB meeting.
  3. Checks for the review fee, CIF and deposit.  See QHRRP 5000-020 (Schedule of Fees).

Note:  Due to the accounting process, property owners must wait 30-days to resubmit a new application for the same project.

Appeals
Use the below chart to determine appeal rights…

If… then…
an application has been denied by the ARB the property owner has the right to appeal the denial at the next regularly scheduled ARB meeting.
the ARB overturns its original decision then a permit will be issued.  See Note.
the ARB denies the appeal the property owner has 30 days from the date of the ARB meeting that denied the application, to appeal to the Queen’s Harbour Board of Directors.
the BOD overturns the ARB denial then a permit will be issued.  See Note.
The BOD does not overturn the ARB denial the property owner will receive a partial refund per QHRRP 5000-015 (Review & Construction Impact Fees (CIF) and Deposits).

Note:  Any additional required documentation, sample, photographs, etc… must be submitted to the ARB Coordinator within 14 days after either the ARB or the BOD overturn on appeal.
