Is responsible to…
Board of Directors adopt these rules, regulations and policies and to determine the appropriate enforcement action in response to any other violations that may arise, from time to time.  The Board of Directors shall also appoint a Fines and Appeals Hearing Committee as outlined in the Committee Composition Policy (QHRRP 8000-015).
Property Manager
  • receive and process any complaints alleging a violation of the rules, regulations and policies.
  • make a determination in response to any complaints, and in response to any observations made by Management, in the absence of a complaint, whether an apparent violation of the rules, regulations and policies has occurred.
  • issue courtesy notices, notices to correct, and fine/suspension notices in response where the apparent violation is listed on the Common Violation Schedule.
  • promptly bring to the attention of the Board of Directors any complaint or observation…
    • which constitutes an apparent violation not listed on the Common Violation Schedule,
    • where Management is uncertain as to whether the complaint or observation constitutes a violation or not, or
    • where the complaint or observations suggests that an apparent violation has existed for more than six months.
  • to levy fines and suspensions pursuant to the Common Violation Schedule, or direction of the Board of Directors.
  • present all appeals of any fines or suspensions to the Fines and Appeals Hearing Committee for adjudication.
  • notify affected property owners of the decisions by the Fines and Appeals Hearing Committee.
  • effect the imposition of any fines or suspensions approved by the Fines and Appeals Hearing Committee; and
  • track all apparent violations and report regularly to the Board of Directors regarding the resolution of same.
Fines and Appeals Hearing Committee
  • hear all timely appeals filed by property owners in response to the levy of a fine or suspension.
  • by majority vote confirm or reject the fine or suspension levied by the Board of Directors.
  • provide written notice to property owners of the decisions of Fines and Appeals Hearing Committee.

Note:  A property owner who does not believe that a fine or suspension has been properly levied must file their appeal to the Fines and Appeals Hearing Committee within 14 days after the fine or suspension is levied. Because every property owner has the right to a hearing before an independent committee, appeals will not be considered by the Board of Directors.
