Florida Statute 328.17

Property owner renters
Resident and lot owner tenant slip renter accounts…

If past due… Then…
30 days Slip Fees, LSA and Utility charges shall be subject to interest penalties of 1.5% per month (an annualized rate of 18%) from the Due Date once the account becomes Past Due.
2 Calendar Months
  • The Monthly Rate converted to Daily Rate for Monthly slip renters.
  • suspension of Lock Access.
3 Calendar Months
  • suspension of automated gate access
  • place with 3rd party collection.
  • the Association may require vessel to be removed by owner with settlement of account.
  • filing of Maritime Lien.
5 Calendar Months (60 days past owner notification of intent to initiate Florida Statute 328.17) – Option to initiate Florida Statute 328.17 including sale of vessel.
Non-resident renters

  • place with 3rd party collection.
  • the Association will require vessel to be removed by owner with settlement of account.
  • a Maritime Lien may be placed on the vessel and the Owners’ Association will follow the Florida State Maritime Statutes and take all appropriate legal action which may include sale of the vessel.
4 Calendar Months (60 days past owner notification of intent to initiate Florida Statute 328.17) – Option to initiate Florida Statute 328.17 including sale of vessel
