Note:  With regard to lot setbacks, the owner/builder are responsible for location of all construction pursuant to all laws, codes and permits.

NOTE 1 Living Space shall mean and refer to enclosed and covered areas within a Dwelling Unit, exclusive of garages, carports, porches, terraces, balconies, decks, patios, courtyard, greenhouses, atriums, attics, and basements.

NOTE 2With respect to Lots 353 – 388 of the Unit Two land, the front and rear set back lines shall be 20 feet and the side set back lines shall be no less than 7 1/2 feet.

NOTE 3 With respect to the lots in Unit Ten, one side of the dwelling shall be a minimum of 3 feet from the side set back line and there shall be a minimum of 10 feet between the exterior finished walls of the dwelling units.

Except as set forth in Note 2, all set back lines are measured from the exterior finish of the dwelling unit to the lot line.

NOTE 4 – All screen enclosures to be within set back lines. The screen enclosure for Units 25 to 28 may encroach the rear set back line by 5 feet.

NOTE 5 – Units 1 thru 24 may be granted a rear set back variance of up to 15 feet and Units 25 thru 28 may be granted a rear set back variance of up to 10 feet for installation of a pool enclosure. No variance will be granted that would allow the structure to be closer than 15 feet from the rear property line.

NOTE 6See QHRRP 5000-035 (Bella Riva (Unit 29)) for side set back and pool set back requirements.

NOTE 7See QHRRP 5000-040 (Providence Island (Unit 30)).  The front stoop may encroach into the front setback by up to 2 feet and a cantilever balcony may encroach into the front setback by 2 feet. The 25 feet rear set back includes the rear alley. The rear setback shall be a minimum of 18 feet from the edge of alley pavement to the garage. The side setback for units which abut a side alley shall be 5 feet on the alley side. Special consideration may be given to the rear setback on lot numbers 13, 14, 36, 37, 38, 39 and 52.

NOTE 8On the first floor, the footprint of the house, including the garage and all covered areas (walkways, porches and covered courtyards) must be 1,800 square feet.

NOTE 9 Unit 8 and Unit 9, Unit 24 and Unit 25 must have 12 feet between buildings.
