E-Bikes and Pedal-Less Electric Vehicles

Purpose
Our community welcomes the use of electric bicycles and small electric vehicles as convenient, eco friendly ways to get around. This policy is designed to help everyone enjoy these devices safely while keeping shared spaces comfortable for all residents.
Definitions
The table below outlines the types of electric transportation devices and their details:

 

Device type and category Detailed information
E-bike: A device with pedals and an electric motor that provides assistance.

 

 

A device with pedals and an electric motor that provides assistance, including Class 1, Class 2, and Class 3 e-bikes.

Pedal-less Electric Vehicle Type: Pedal-less Electric Vehicle.

A small electric transportation device without pedals (such as electric scooters or throttle-powered bikes).

Prohibited e-bike areas
The operation or use of e-bikes, pedal-less electric vehicles or similar devices is strictly prohibited in the following areas:

  • All sidewalks and pedestrian pathways
  • Gated recreational areas
  • Swimming pool areas
  • Tennis courts
  • Pickleball courts
  • Basketball courts
  • Pavilions and gathering areas
  • Landscaped or common-use areas
  • The lock area, marina, floating docks, and all waterfront structures
  • All golf course property and related amenities, including cart paths, fairways, greens, roughs, practice areas, and any infrastructure associated with golf course operations

Note: Any e-bike, pedal-less electric vehicles or similar devices found in a prohibited or restricted area may be removed from that area and will be returned upon request, with all associated costs charged the operator and/or owner (and parent or guardian if the operator is a minor).

Compliance with Florida traffic laws
All operators shall comply with all posted traffic control devices and all applicable provisions of Florida Statutes 316.
Safety expectations
When riding, you must

  • be aware of pedestrians at all times and give them the right of way
  • wear a helmet if you are under age 18
  • have installed audible warning equipment (bell, horn, or similar) sufficient to alert pedestrians and others of their presence
  • use lights or reflectors if riding in the evening, and
  • ride with care—no racing, stunts, or behavior that could risk injury.

Note: Any requirement under state law or local ordinance, including helmet requirements, licensing requirements, or equipment requirements, will automatically apply within the community and does not require an amendment to this policy to be enforceable.

Liability and risk for electric devices
Liability, Assumption of Risk, and Indemnification for E-Bikes, Pedal-less Electric Vehicles, and Similar Devices

Any person operating an e-bike, pedal-less electric vehicle or any similar motorized device within the community does so entirely at their own risk.

The Queen’s Harbour Association, the Club, the Golf Course, their respective boards, officers, employees, agents, and all individual property owners bear no liability for any injury, death, loss, or property damage arising from or related to the use or operation of such devices. This limitation of liability applies under all circumstances, including but not limited to roadway, sidewalk, common‑area, or golf‑course conditions; landscaping, irrigation, improvements, or fixtures; visibility or maintenance conditions; or any alleged defect, hazard, or obstruction. No condition within the community shall be deemed to create liability.

By operating such devices within the community, the operator and/or owner (and parent or guardian if the operator is a minor):

  1. Assumes all risks, including the risk of injury, death, or property loss, regardless of cause or circumstance.
  2. Accepts full responsibility for:
    • any injury to themselves or others,
    • any damage to their equipment, and
    • any damage to Association, Club, Golf Course, or private property.
  3. Waives all claims against the Association, the Club, the Golf Course, their respective boards, officers, employees, agents, individual homeowners, and all affiliated persons or entities.
  4. Agrees to indemnify, defend, and hold harmless all such parties from any claim, demand, action, or liability arising from or related to the operation of the device.

All legal expenses—including attorney’s fees, court costs, and related expenses—incurred by the Association, the Club, the Golf Course, or any property owner in defending any claim associated with such operation shall be the sole responsibility of the operator and/or owner. The Association may assess such costs, impose fines, recover damages, or place liens in accordance with governing documents and Florida law.

Right to seek law enforcement assistance
Nothing in this policy shall limit the right of any person or entity to seek law enforcement assistance at any time.
Reporting property damage responsibilities
Any damage to Association property must be reported immediately. The responsible party shall bear full financial responsibility for all repairs and related costs.
Prohibited vehicles on community roads
To maintain safety, the following aren’t allowed on Queen’s Harbour roads and streets or other Common Property:

  • Gas powered bikes or scooters
  • Go carts
  • Mini-bikes
  • All-Terrain Vehicles (ATVs)
  • Motorized skateboards
  • Any device the Board determines to be unsafe in shared community areas.
Violation
Violations may result in a fine being levied against the offending property owner by the Association.
